1. Acceptance of Terms
By accessing or using aNotepad.com (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
We may update these terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised terms.
2. Accounts & Eligibility
You must be at least 13 years old to use aNotepad. If you are under 18, you must have permission from a parent or legal guardian.
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
aNotepad reserves the right to suspend or terminate accounts that violate these terms.
3. User Content & Ownership
You retain full ownership of any content you create or upload to aNotepad. We do not claim ownership of your notes, files, or other materials.
By using the Service, you grant aNotepad a limited, non-exclusive license to host, display, and transmit your content solely for the purpose of operating the Service.
aNotepad reserves the right to remove any content that violates these terms or applicable law, without prior notice.
4. Acceptable Use
You agree not to use aNotepad to:
- Upload, share, or distribute illegal, harmful, threatening, abusive, defamatory, or obscene content
- Distribute malware, viruses, or any code designed to harm or disrupt systems
- Engage in spam, phishing, or fraudulent activity
- Impersonate any person or entity, or misrepresent your affiliation
- Scrape, crawl, or use automated tools to access the Service beyond the provided API
- Attempt to gain unauthorized access to other users' accounts or data
- Use the Service in any way that violates applicable local, national, or international law
5. Paid Content — Creators
aNotepad allows users to sell access to their notes and collections ("Paid Content"). By listing Paid Content, you agree to the following:
- You must own or have the necessary rights and licenses to sell the content you list
- Content must be accurately described. Misleading listings, bait-and-switch tactics, or fraudulent pricing are prohibited
- You are solely responsible for the quality, accuracy, and legality of your Paid Content
- You are responsible for any applicable taxes on income earned through Paid Content sales
- aNotepad may remove Paid Content that violates these terms or receives repeated complaints
6. Paid Content — Buyers
By purchasing Paid Content on aNotepad, you agree to the following:
- All purchases are final. Blockchain transactions are irreversible and cannot be refunded by aNotepad
- Purchased content is for your personal use only. You may not redistribute, resell, or share purchased content without the creator's permission
- aNotepad does not guarantee the quality, accuracy, or completeness of any Paid Content. Content disputes are between the buyer and the creator
- You are responsible for ensuring you send the correct amount to the correct wallet address on the correct network
8. Disclaimers & Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
aNotepad does not warrant that the Service will be uninterrupted, error-free, or secure. We are not liable for any loss of data, content, or access.
To the maximum extent permitted by applicable law, aNotepad and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Service or any transactions conducted through it.
Our total liability for any claim arising from the Service shall not exceed the amount you have paid to aNotepad (if any) in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless aNotepad, its operators, affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:
- Your use of the Service or any activity under your account
- Your content, including any Paid Content you create or sell
- Any transactions you conduct through the Service, whether as buyer or creator
- Your violation of these Terms of Service or any applicable law
10. Dispute Resolution
Disputes related to Paid Content transactions (such as content quality, delivery, or pricing) are between the buyer and the creator. aNotepad is not a party to these transactions and is not obligated to mediate or resolve such disputes.
If you have a complaint about another user's conduct on the platform, you may report it to us via the Report Abuse page. aNotepad may investigate at its discretion but is not required to take action.
11. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law principles.
Any legal action or proceeding arising under these terms shall be brought exclusively in the courts located in British Columbia, Canada, and you consent to the jurisdiction of such courts.
12. Changes to These Terms
We reserve the right to modify these Terms of Service at any time. When we make changes, we will update the "Last Updated" date at the top of this page.
Your continued use of the Service after any changes indicates your acceptance of the new terms. If you do not agree with the revised terms, please discontinue use of the Service.
